Notice to User:
By installing the system and software you purchase
from Austin Systems , you accept all of the terms and conditions of this
agreement. The enclosed Austin Systems Hardware and Software programs or
just the software (the "SOFTWARE") is licensed by Austin Systems
for use only on the terms set forth herein. If you do not agree to these
terms, return the entire product within 30 days for a full refund.
Scope of Use:
You have the right to use the enclosed
SOFTWARE on any computer or network on which the specific package has been
installed, provided that there is no more than one user per licensed program
at a time. If you install the SOFTWARE on a network server, you must
purchase a separate copy of the SOFTWARE for each node (computer terminal)
that will be used simultaneously to operate the SOFTWARE unless and
otherwise you have a written agreement with Austin Systems to the contrary.
You may not transfer the SOFTWARE from one computer to another. You may do
so only after informing Austin Systems and requesting for a new set of
installation diskettes/CD Rom as the case might be. Again, you alone are
authorized to use the SOFTWARE on one computer at a time.
Copyright:
The SOFTWARE has been designed and developed by and is
owned by Austin Systems and is protected by United States and Indian
copyright law and international treaty provisions. No copies of the SOFTWARE
may be made without the express written consent of Austin Systems. You may
not copy the written materials that accompany the software.
Other restrictions:
You may not rent or lease the SOFTWARE. You may not
reverse engineer, de-compile, or disassemble the software. You may not
create derivative works from the SOFTWARE without the express written
consent of Austin Systems. You agree to use the software as it has been sold
to you. You may definitely not embed the SOFTWARE into your own software
without the express written consent of Austin Systems Inc
Limited Warranty:
Austin Systems warrants that for a
period of ninety (90) days from the date of purchase the CD(s) or diskette(s)
on which the SOFTWARE is furnished will be free from any defects and that
the software is properly recorded. Austin Systems' entire liability and your
exclusive warranty will be to replace the diskettes.
To the original customer
only, Austin Systems provides the following warranty: that for ninety (90)
days after the original date of delivery to you, if you are dissatisfied
with the SOFTWARE for any reason, you may return the complete product in
good condition along with your receipt to Austin Systems postage pre-paid,
for a full refund once you have contacted Austin Systems to receive a return
authorization number.
Limit of Liability:
Austin Systems makes no warranty, express or implied,
with respect to this SOFTWARE, its quality, performance, merchantability, or
fitness for a particular purpose. In no event shall Austin Systems, UNIK
Software House or anyone involved in the creation of this SOFTWARE, be
liable for direct, indirect, special, or consequential damages. The SOFTWARE
is sold "as is", and the purchaser assumes the entire risk of its
performance and suitability to the purchaser's purpose.
Because of the
special nature of the software, the SOFTWARE should not be used as the
exclusive determinant of any experiment or hypotheses. Where life is
involved, results obtained with the SOFTWARE should be examined extremely
carefully before any conclusions are made. Austin Systems, takes no
responsibility for any inconvenience, loss of time, property, or product
damage, personal damage, or any other incidental or consequential damages
resulting from the use of this SOFTWARE. While Austin Systems and UNIK
Software House have developed this special software package exclusively as a
speciality product, all utilization, interpretation and customization
requirements are the sole responsibility of you, the user.
